M  ARRIAGE SETTLEMENT AGREEMENTS

Some people find that their marriage just isn't working and both parties agree that divorce is the best solution. However, divorce proceedings can be quite costly and become an emotional drain. For people who can agree on most of the issues involved in a divorce (i.e. property division, child support, and visitation), using a marriage settlement agreement can be a "friendlier" way to end the marriage.

A marriage settlement agreement is exactly what it sounds like: an agreement where the terms of your divorce are outlined and agreed to by both parties. The advantages of a marriage settlement agreement are numerous. For example, the cost of a marriage settlement agreement in my office is $1,000 in most instances. A legal battle in divorce court, on the other hand, can easily add up to $5,000 or more for each party! The cost savings alone is a great incentive to go this route.

Another advantage is that it avoids the emotional strain that a divorce causes most families. Couples who have children know what a toll a divorce court proceeding can have on the kids, not to mention to the parties themselves. A marriage settlement agreement forces the parties to come to a reasonable compromise for the issues they face, keeping the proceeding civil, and avoiding a big portion of the heartache.

Finally, there is the time savings that you receive from using a marriage settlement agreement. Instead of scheduling hearings and trials to work out each issue, all of the issues are agreed upon at one or two scheduled meetings. Then, when it comes time to file the paperwork, an uncontested proceeding can be obtained.

Marriage settlement agreements aren't for everyone. Both parties must agree to be reasonable and be able to compromise on the issues. Sometimes, this just isn't possible. But in those instances where it is possible, it is a much friendlier, less expensive, and less draining way to go.
